Welcome to Immich Cloud ("Service"), a managed photo and video management platform operated by K3Mate ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms of Service ("Terms").

1. Acceptance of Terms

By creating an account or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Description of the Service

Immich Cloud provides a fully managed Immich instance for self-hosted photo and video backup, organization, and sharing. The Service includes automatic updates, backups, infrastructure management, and machine learning-powered features such as facial recognition and smart search.

3. Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must notify us immediately of any unauthorized use of your account.
  • You must be at least 18 years old to use the Service.

4. Subscription and Payments

  • Access to the Service requires a paid subscription.
  • All fees are billed in advance on a recurring basis (monthly or annually).
  • Storage limits are determined by your subscription plan.
  • Prices are subject to change with 30 days' prior notice.
  • Refunds are handled in accordance with our refund policy.

5. Your Content

  • You retain full ownership of all photos, videos, and media you upload to the Service ("Your Content").
  • You grant us a limited license to store, process, and display Your Content solely to provide the Service.
  • We do not claim any intellectual property rights over Your Content.
  • You are solely responsible for the content you upload and must ensure it does not violate any applicable laws.

6. Acceptable Use

You agree not to:

  • Use the Service to store or distribute illegal content.
  • Upload content that infringes on third-party intellectual property rights.
  • Attempt to gain unauthorized access to other users' accounts or data.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Use the Service for commercial redistribution without prior written consent.
  • Reverse engineer, decompile, or disassemble any part of the Service.

7. Storage and Data Limits

  • Each subscription plan includes a defined storage quota.
  • If you exceed your storage limit, uploads may be restricted until you upgrade or free up space.
  • We reserve the right to enforce fair usage policies to maintain Service quality.

8. Service Availability

  • We strive to maintain 99.9% uptime but do not guarantee uninterrupted access.
  • Scheduled maintenance windows will be communicated in advance.
  • We are not liable for any downtime caused by factors beyond our reasonable control.

9. Machine Learning Features

  • The Service may include AI-powered features such as facial recognition, object detection, and smart search.
  • These features process Your Content locally within your managed instance.
  • You can enable or disable machine learning features at any time through your settings.

10. Data and Privacy

  • Your use of the Service is also governed by our Privacy Policy.
  • You retain ownership of all data you upload to the Service.
  • We will not access your photos, videos, or personal media except as necessary to provide the Service or as required by law.

11. Intellectual Property

  • The Service, including its original content, features, and functionality, is owned by K3Mate and protected by intellectual property laws.
  • Immich is an open-source project. Our Service provides managed hosting of the Immich software.
  • You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

12. Termination

  • You may cancel your subscription at any time through your account settings.
  • We may suspend or terminate your account if you violate these Terms.
  • Upon termination, your data will be retained for 30 days before permanent deletion.
  • You may export your data at any time before account deletion.

13. Limitation of Liability

To the maximum extent permitted by law, K3Mate shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data or media.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email or through the Service. Continued use after changes constitutes acceptance of the updated Terms.
